TOM went to a 4S to replace a tire. The mechanic informed him that original factory tires were out of stock and, with TOM’s agreement, installed a non-original tire. This constituted consumer fraud, and the court ordered a refund plus treble damages.  

My Thoughts:  

In the market, there is inherent information asymmetry between consumers and businesses. For businesses, the duty to inform is not just about stating facts. When safety is involved, they have an obligation—based on their professional expertise—to actively explain potential risks, not just bury them in lengthy contracts.  

While getting a refund and treble damages is beneficial, it requires significant time and effort to pursue. Therefore, it’s advisable for consumers to better understand the details of their purchases upfront to avoid wasting their own time and energy.
